Workers' Comp for Small Contractors: Rules Rates and Exemptions
Workers’ comp rules are set by each state and change — verify your state’s requirements and get advice from a licensed agent and/or attorney. This isn’t legal advice.
What workers’ comp does
Workers’ comp covers medical costs and lost wages when an employee is injured on the job — and in exchange, it generally shields you from being sued directly for that injury. For physical trades, where injuries are a real risk, it’s essential protection for both your workers and your business. It’s separate from general liability, which covers customers and their property (general liability).
Who needs it (the rules vary by state)
- Most states require it once you have employees — often from the very first one, though thresholds differ.
- Owners/officers can sometimes exempt themselves, depending on the state and entity.
- Subcontractors/1099s are a trap: misclassifying employees as contractors to skip comp can backfire badly, and you may owe coverage for uninsured subs. Verify status carefully.
- Penalties for going without can be severe — fines, stop-work orders, and personal liability for injury costs.
Check your specific state’s rules — this is one area where “I heard you don’t need it” gets contractors in serious trouble.
What drives the rates
Workers’ comp premiums are generally based on:
- Your payroll — rates are charged per $100 of payroll.
- Job classification codes — riskier work (roofing, etc.) carries much higher rates than office work.
- Your experience mod (EMR) — your claims history adjusts your rate up or down over time.
- State — rates and rules vary widely by state.
How to manage the cost
- Classify employees correctly — misclassification inflates premiums or creates liability.
- Invest in safety — fewer claims lowers your experience mod and your rate long-term.
- Shop carriers and consider state funds or bundling.
- Audit payroll accuracy — premiums reconcile to actual payroll.
- Fold it into labor burden so it’s captured in your pricing (labor burden).
