Texting Customers Legally: TCPA Basics for Small Service Businesses

Texting is the highest-response channel a service business has — reminders, on-the-way alerts, and review requests all work best by text. But text marketing is regulated, and the penalties for getting it wrong are steep. Here’s a plain-English guide to the TCPA basics every small business should follow.

This is general information, not legal advice — consult an attorney for your specific situation.

What the TCPA is (and why it matters to you)

The Telephone Consumer Protection Act governs calls and texts to consumers in the US. It requires consent before you send marketing messages and gives customers the right to opt out. Violations carry per-message statutory damages, so a sloppy blast list is a real liability — not just a spam-folder problem.

The core rules in plain English

  1. Get consent. Don’t text people who didn’t agree to it. For marketing texts, you generally need clear prior express written consent.
  2. Transactional vs. marketing. Service messages a customer expects (appointment reminders, “on my way,” an invoice) sit differently than promotions — but consent and opt-out best practices still protect you. When in doubt, treat it like marketing.
  3. Honor opt-outs immediately. Support STOP and remove the number promptly.
  4. Identify yourself. Every message should make clear who it’s from.
  5. Respect quiet hours and reasonable frequency.

How to collect consent the right way

  • Add a clear checkbox/opt-in when customers book or give their number — state what you’ll send.
  • Keep records of when and how each customer consented.
  • Make opt-out obvious in messages (“Reply STOP to opt out”).
  • Don’t buy lists or text strangers — ever.

Where review requests fit

A post-job review request to your own customer, who gave you their number to service a job, is a natural transactional-style follow-up — but the safe path is the same: have consent, identify yourself, honor opt-outs, and keep it relevant and infrequent. Review-request platforms build these safeguards in.

Practical compliance checklist

  • Consent captured and logged at booking.
  • Clear sender identity on every message.
  • Working STOP/opt-out on every list.
  • Reasonable timing and frequency (reminder cadence).
  • Use a reputable platform, not your personal phone (text templates).
