Is Review Gating Illegal? Google Policy vs. FTC Law Explained
What review gating is
Gating is any process that filters who gets to leave a public review based on how they feel first. The classic version: a survey asks “How was your experience?” — happy responders are sent to your Google review link, unhappy ones to a private “tell us more” form that never reaches the public. The public profile ends up artificially rosy.
Is it illegal?
“Illegal” depends on where you are, but here’s the practical reality:
- Google policy: explicitly prohibits “review gating.” Google can filter or remove affected reviews and, in bad cases, penalize the profile.
- Platform terms: Yelp, Trustpilot and others ban selectively soliciting only positive reviews.
- FTC (US): the FTC’s rule on fake and deceptive reviews targets practices that misrepresent overall sentiment. Suppressing negative reviews to mislead consumers can bring real penalties. See the FTC fake review rule.
Even where no specific law names “gating,” presenting a deceptively one-sided picture of customer sentiment is the kind of thing regulators and platforms act on.
What you can do (and it works better anyway)
- Ask everyone. Send the same review request to all customers, not just the ones you think will rave. A few critical reviews actually make your profile more credible.
- Fix problems first — for real. If a customer is unhappy, resolve it genuinely. Many will update or soften their review on their own once you make it right. Use a service recovery script.
- Respond publicly to the negatives. A calm, helpful reply does more for trust than hiding the review would. Here’s how to respond to negative reviews.
The mindset shift
A perfect 5.0 with no critical reviews reads as fake to modern consumers — and to Google. A 4.7 with thoughtful responses to the occasional complaint reads as real and trustworthy. Aim for authentic, not flawless.
